General Information

Work Effects respects the privacy of our customers and is committed to upholding the confidentiality and security of our customers’ and web-site users’ personal information. Any personal information gathered will be kept strictly confidential and will only be used in ways for which customers have specifically consented. We will never sell or rent any personal information collected to any third party. We will take special care to protect the privacy and security of your information.

Personal Information

We use the term “personal information” to describe most types of information that can be linked to an identifiable individual. Examples include names and e-mail addresses. Business demographic information (such as job title, business address, business telephone, business unit, department, etc.) is not typically considered sensitive personal information. However, in cases where our records include both personal and business contacts and we are unable to separate them, we will handle such records as personal information.

Collection and Use of Personally Identifiable Information

Work Effects operates as a data processor for its customers. Work Effects’ customers act as data controllers. Work Effects maintains only that Personal Information which its customers have asked Work Effects to process. It is the Work Effects customer’s responsibility to ensure that the data the customer collects can be legally collected in the country of origin. The Work Effects customer is responsible for giving its employees, applicants and users the appropriate level of notification that Personal Information is being collected and maintained.

Work Effects will store personally identifiable information when it is provided by our customers. This information will be collected through a secure browser session, provided as a data feed by the customer organization or a secure transfer protocol.

Work Effects Privacy Principles

Work Effects needs to collect, use, retain and disclose personal information to provide services to our customers and web-site users. We request only the personal information necessary to provide our services and will tell the customer or web-site user how we intend to use this information. To ensure privacy is protected, Work Effects is committed to honoring the following principles:

Identifying Purposes

To enable customers to make an informed decision about the information they provide, Work Effects will clearly explain to them, at or before they provide the information, the reasons for collecting their personal information. If we intend to use or disclose their information in ways other than those described at the time of collection, we will ensure that they are informed and their consent obtained for the new use prior to using the information for a new purpose.

Limiting Data

To protect privacy, Work Effects will only collect, use, retain or store personal information that is relevant to the purposes the customer is informed of at the time of collection.   By collecting information limited to these purposes, Work Effects helps protect the customer from unnecessary or accidental uses of personal information.

Visitors to our web-site may have certain technical information logged from their computer’s Web browser when they visit us on the internet.   This information includes their internet address, the address of the Web site they are coming from, the amount of time they spend visiting our Web site, the pages visited, the operating system and web browser software they use, and, if they link to us through a search engine, the keywords used to find our Web site.   The logs do not record personal information, can be accessed only by Work Effects through its secure web hosting service and are used solely to track visits to our site and improve its content and layout.

When a person visits our Web site, they are assigned a temporary text file called a cookie through their Web browser.   It is placed on their computer for programming purposes only and enhances their use of the site by providing a unique identifier as they move from page to page.   The cookie is never redirected to servers outside our site.

Limiting Use, Integrity, Disclosure, and Retention

Just as Work Effects takes steps to limit the types of information we collect from customers, we carefully regulate how we handle their personal information. We do not use their information for purposes other than those to which they have consented, or as required by law.  Work Effects offers online assessments as part of its services to customers. We respect the participant’s right to anonymity above all else.

Our assessments may process demographics considered as Personal Identifiable Information from our customer’s HR information systems which they provide. This information is kept strictly confidential, is reported only in its aggregated form and is not used to identify individuals. Individual responses will not be revealed to any customer organization or group. Organizations will be identified only with their consent.

Should Work Effects require the services of third parties to handle customer information, we require them to adhere to privacy procedures that will keep personal information confidential.   These third parties will be given only the information necessary for performing their information-handling services. Work Effects does not sell or trade personal information for commercial purposes.

Work Effects is committed to retaining customer personal identifiable information only as long as is necessary for the purposes for which it was collected and/or specifically defined by the customer. Work Effects is also committed to deleting or destroying the records containing that information when they are no longer required; this will be done in ways that will ensure their continued privacy.

Accuracy

Our assessments rely exclusively on customers for its information about them. This information is provided by the customer from their source systems and should be controlled by the customer.  If requested for applicable scenarios, where Work Effects can make data changes, authorized Work Effects personnel can make changes to this information and only as directed by an authorized member of the customer organization.

Safeguards

Work Effects uses appropriate safeguards to protect the privacy of our customers’ personal information. These safeguards are designed to prevent unauthorized access, disclosure, copying, use or modification. Records are accessible only to staff who have been given the authority to access them and only as is necessary to provide services to the customer.

All Work Effects employees and contractors receive training on information security, data privacy and risk management on an annual basis. Customer personal information is accessed, handled and stored only in encrypted format. Access to customer and employee personal information on mobile devices is strictly prohibited. Data is erased from desktop computers, laptops and on-line storage devices when a customer engagement ends and the storage expiration date has passed.

Transparency

So that customers can be confident that Work Effects is handling their personal information appropriately, Work Effects will make information about its policies and practices concerning management of personal information readily available that does not breech security confidentiality of information systems.

Individual Access

If at any time a customer has a question about our records containing their personal information, we will do our best to answer it. Customers have the right to be told about the kind of personal information Work Effects maintains, how it is used, and with whom it is shared. Incorrect information will be promptly corrected, or, if necessary, deleted as directed by an authorized member of the customer organization.

In special circumstances, Work Effects may need to refuse or limit an access request. For example, we will never disclose information that might reveal personal information about another person or customer organization without permission or will reveal his or her responses to an assessment or interfere with a legal investigation.

Addressing Comments and Concerns

An important measure of Work Effects’ adherence to these privacy principles is our customer’s perception of our practices and procedures. We welcome their comments and suggestions concerning this privacy statement and will respond to any concerns they may have about its application. Notification of Changes/Choice

Work Effects will maintain Personal Information in accordance with this Privacy Policy. If Work Effects decides to change this Policy, Work Effects will post the changes on our website so our customers and/or their employees, applicants and users are aware of what Personal Information Work Effects processes, how Work Effects uses it, and under what circumstances, if any, Work Effects discloses it. If at any point Work Effects decide to retain or use Personal Information in a different manner, Work Effects will notify its customers by way of email or by posting a notice on Work Effects’ website for at least 30 days prior to the change in use. Customers, in turn, are responsible for their users and providing them a choice as to whether or not Work Effects uses their Personal Information in this revised manner.

Onward Transfer

We are a corporation with operations headquartered in Minneapolis, MN doing business on a global scale. We have developed global data practices designed to assure Personal Information is appropriately protected. Our primary data centers are housed in Microsoft Azure data centers that comply to the highest standards of information security and privacy compliance. We currently do not employ other companies and individuals to perform functions on our behalf as sub processors. If we disclose Personal Information to a third party or to Work Effects employees outside of the United States, we will ensure that such party has agreed to abide by the Privacy Shield principles, is subject to the Data Directive, or can otherwise assure adequate protection of such Personal Information.

Access/Correction

In most cases, when Work Effects collects Personal Information, it does so on behalf of a customer. To request access to, correction, amendment or deletion of this Personal Information, a user should contact the employer or company to which it was originated and provided.

Legal Disclaimer

We may disclose Personal Information when required by law or regulation or in the good faith belief that such action is necessary in order to conform to the edicts of the law, comply with legal mandates, or to protect the rights, property, or personal safety of Work Effects, its users and the public.

Cookies and Links to Other Sites

We may use cookies to enhance a user’s experience while using our hosted applications. Cookies are a small piece of data stored locally by your browser that saves information and helps identify you to web sites upon subsequent visits. Cookies are uniquely assigned to a computer, and can only be read by a Web server in the domain that issued the cookie. Cookies generally assist users by performing certain functions such as saving passwords and personal preferences regarding the sites.

You may have the ability to accept or decline cookies. Most Web browsers automatically accept cookies, but you can usually modify your browser setting to decline all cookies if you prefer. Alternatively, you may be able to modify your browser setting to notify you each time a cookie is tendered and permit you to accept or decline cookies on an individual basis. If you choose to decline cookies, however, that may hinder performance and negatively impact the use of the hosted application.

Children’s privacy

Work Effects is committed to protecting the privacy needs of children and we encourage parents and guardians to take an active role in their children’s online activities and interests. Work Effects does not knowingly collect information from children under the age of 13 and Work Effects does not target its website or its products to children under the age of 13.
